◊ Giving A Voice To Those Seriously Injured Or Killed By Negligence Since 1984

Phoenix Birth Injury Attorney

We know that expecting and delivering a new baby should be a happy time for mothers and fathers, a time free from any medical injury or medical complications. We also know that birth injuries can occur at any point during a pregnancy – whether in the prenatal period, during labor and delivery, during the post-natal period, or in the newborn nursery.

Our birth injury practice is, and has always been, dedicated to giving a voice to those injured infants and those who love them. We do not represent insurance companies, corporations, or defendants in obstetrical injury or birth injury litigation. Our one and only goal is obtaining justice for the injured child, and securing financial compensation in order to provide for their medical, rehabilitation, nursing, attendant and medical care needs. Contact us for a skilled evaluation of your claim.

At The Law Office of Robert H. Kleinschmidt, P.C., we have helped parents, grandparents and guardians of children with:

  • Cerebral palsy
  • Hyperbilirubinemia (jaundice)
  • Hypoxic ischemic encephalopathy
  • Oxygen deprivation
  • Brachial plexus (Erb's palsy, shoulder dystocia)
  • Macrosomia (large babies)
  • Leukomalacia
  • Kernicterus
  • Triplegia
  • Uterine rupture
  • Cortical blindness
  • Quadriplegia
  • Spasticity
  • Hydrocephalus
  • Seizures
  • Other obstetrical injures occurring during the birth process

We have handled cases where negligence caused injury during forceps deliveries, vacuum extractions, extended second stage of labor, excessive use of Pitocin or other drugs, low amniotic fluid, twisted, compressed or compromised umbilical cords, cephalopelvic disproportion, babies who were too large for their gestational age, placental abruptions, placenta previa, eclampsia, and other complications which arise during the obstetrical and birth process. We will analyze fetal heart rate monitor tracings and fetal pH scalp sampling to determine if your infant was properly monitored.

While cerebral palsy and mental retardation can be caused by things other than birth trauma, we can quickly assess the management of your labor and delivery and make a threshold determination if your child's injury was related to oxygen deprivation in the birth process.

Experience, Skill and the Extensive Resources to Make a Difference

We have worked with parents for 25 years on life care plans to provide the special treatment, occupational therapy, medication and attendant care that their injured children required. Because of our specialized knowledge and experience in the field of obstetrical injury, birth trauma, brain injury and cerebral palsy, we know how to build a life care plan that protects a child now and in the future. We are familiar with, and regularly consult with specialists in the field of fetal monitoring and obstetrics. We are able to quickly assess the quality of medical care by reviewing medical records and fetal monitoring tracings.

If you are a parent with a special needs child because of birth injury, call or contact us. If your child has suffered injury before, during or after birth, we may be able to help. When a physician, nurse, midwife, anesthesiologist, obstetrician or hospital fail to provide appropriate care during the labor and delivery, prenatal or postnatal period, with resulting catastrophic birth injury, mothers and fathers are immediately placed in a position they never dreamed of: How can I assure that my child will receive the medical attention necessary to help him or her reach their full potential? How can I make certain that after I die, there will be someone to take care of my child's needs?

We Care About the People We Serve

We work with parents, grandparents and guardians of children across the State. We understand the economic hardship that flows from a lifetime of disability. We also understand that State agencies, Regional Centers, and other social service agencies are not enough – families who have sustained a loss because of the negligence of a physician, hospital or HMO are entitled to whatever it costs to help their child reach his or her full potential.

When we choose to take a case, we become personally invested in the clients we serve to obtain justice for those who have been injured. We become their voice and the voice of their loved ones to obtain that justice. From the first telephone call to our office and throughout your case, you will receive the personal attention of Mr. Kleinschmidt and his staff. Unlike other offices where you speak with an associate, you will speak with and have direct contact with Mr. Kleinschmidt. He will be available to answer all of your questions concerning your case. We understand the personal, emotional, and financial stresses that are put on families when a loved one is injured and we will be with you every step of the way. We pride ourselves on our personal service to our clients.

We also understand that no two cases are alike and because of that, we have a strong network of experts and consultants who are preeminent in their fields who can testify regarding the exact issues in your case. Unlike other firms, your case is personal to us, and attorney Robert Kleinschmidt has a unique perspective because he spent the first five (5) years of his practice defending those he now pursues for negligence. He understands how the "other side" thinks and is ready to meet every challenge presented.
